The two ministries issued a joint document, involving all foreign machinery enterprises!

Recently, The General Office of the State Council forwarded the Measures on Further Encouraging Foreign Investment to set up R&D Centers (hereinafter referred to as the Measures) issued by the Ministry of Commerce and the Ministry of Science and Technology.

According to the Measures, more support will be given to the R&D and innovation activities of foreign investment centers set up in China, so as to better leverage their positive role in serving to build a new development pattern and promote high-quality development.

No doubt, this part also includes all the foreign medical device companies in China.

For foreign-funded enterprises to build research and development centers in China, “Several Measures” put forward a total of 16 policies and measures in four aspects. These include:

Encouraging basic research and supporting foreign-funded R&D centres to use large scientific research instruments, scientific and technological reports and relevant data from major national science and technology programmes in accordance with the law.

For new type of R&D institutions set up by foreign investors to provide services for the research and development of key common technologies in the region, localities can support them in terms of infrastructure construction, equipment acquisition, talent support services and operating expenses.

Encouraging and supporting foreign-funded R&D centres to undertake national science and technology tasks and participate in major national science and technology program projects, publishing project plans in multiple languages on a pilot basis, extending project submission deadlines appropriately and improving the ease of project submission.

Optimizing the management of technology import and export, studying the facilitation arrangements for cross-border technology transfer within multinational enterprise groups, strengthening the policy publicity and interpretation, and do a good job of training and guidance;

To actively carry out biosafety risk assessment on inbound animal and plant GMOs and biological materials introduced by foreign-funded R&D centres for use in national and provincial research projects, and grant quarantine approval facilitation arrangements if they meet the requirements ……

Ministry of Finance: Supporting fair competition between domestic and foreign enterprises

In October 2021, the Ministry of Finance issued the Notice on Implementing the Policy on Equal Treatment of Domestic and Foreign Enterprises in Government Procurement Activities.

The notice makes it clear that in government procurement activities, no distinction shall be made between products produced in China by domestic and foreign enterprises, except for procurement projects involving national security and state secrets.
