Pharmaceutical representatives smashed heavy bribe sentenced! NHSA: All bribe-paying drug companies to be disconnected nationwide

In June 2025, the People’s Court of Gao’an City, Jiangxi Province, publicly heard the case of Huang Mouyun bribing non-state functionaries in accordance with the law.It has been found through trial that the defendant Huang Mouyun was hired by Lei Mougen (handled in another case) to be responsible for the sales work of a traditional Chinese medicine formula granule product of a pharmaceutical company in Jiangxi Province at Gao’an People’s Hospital. In order to increase the sales volume of this traditional Chinese medicine formula granule at Gao’an People’s Hospital, Lei Mougen instructed Huang Mouyun to contact doctors in various departments of the hospital and promised to give the doctors rebates at 10%-15% of the amount of the prescribed medicines. Since December 2018 to the present, the sales volume of this traditional Chinese medicine formula granule at Gao’an People’s Hospital has reached over 10 million yuan, and Huang Mouyun has paid rebates of 1.6363 million yuan to 15 doctors including Hu Mouming, Lei Mou, and Liang Mouyong from Gao’an People’s Hospital. In April 2022, Lei Mougen obtained the sales agency right for traditional Chinese medicine formula granules at Gao’an Maternal and Child Health Hospital, and still entrusted the defendant Huang Mouyun to be responsible for the sales work. He promised doctors a rebate of 8% of the amount of prescriptions written. From July 2022 to the present, the defendant Huang Mouyun has paid a total of 290,000 yuan in rebates to three doctors, namely Zhu Mouhui, Xiong Mougang, and Kuang Mouwu, from Gao’an Maternal and Child Health Hospital.

The court held that the defendant Huang Mouyun, in order to seek improper benefits, gave property totaling more than 1.92 million yuan to multiple staff members of units. The amount is huge, and his act has constituted the crime of bribing non-state functionaries. After arriving at the case, the defendant Huang Mouyun truthfully confessed to the criminal facts, which constituted a voluntary confession, and may be given a lighter punishment in accordance with the law. The judgment is as follows:

Defendant Huang Mouyun is convicted of the crime of bribing non-state functionaries and is sentenced to three years of fixed-term imprisonment, with a three-year suspension of sentence, and a fine of 50,000 yuan; the illegal gains of 250,000 yuan of defendant Huang Mouyun shall be recovered and turned over to the state treasury.

Next step, the National Healthcare Security Administration will guide local healthcare security administrations to conduct credit rating for dishonesty in accordance with regulations, urge enterprises to take timely measures to rectify dishonest behaviors, and adopt relevant restrictive measures to better safeguard the security of healthcare security funds.
