On November 9, 2022, according to the Chinese government procurement website, the 2022 China International Public Procurement Forum will be held by video. The theme of the forum is “Sharing the Future of the Public Procurement Market”, which is jointly held by the Ministry of Finance and the Shanghai Municipal People’s Government.

At the meeting, the Ministry of Finance said that China will actively promote the high-level opening up of the government procurement sector. Xu Hongcai, Vice Minister of Finance, also stressed again that the scale of government procurement market has been expanding, increasing from 100.9 billion yuan in 2002 to 3,639.9 billion yuan in 2021, and the proportion of government expenditure has correspondingly increased from 4.6% to 10.1%. He stressed that China adheres to the principles of openness, transparency and fair competition in government procurement, and ensures that domestic and foreign enterprises participate in fair competition in government procurement.

As we all know, as early as last October, the Ministry of Finance issued the Notice on Implementing the Policy on Equal Treatment of Domestic and Foreign Enterprises in Government Procurement Activities.

The circular makes it clear that in government procurement activities, products produced in China by domestic and foreign-funded enterprises shall not be treated differently, except those involving national security and state secrets. Regardless of whether the supplier of a product produced in China is a domestic or foreign-funded enterprise, the supplier’s right to participate in government procurement activities on an equal basis shall be guaranteed according to law.

In short, medical devices manufactured in China by foreign companies will enjoy equal treatment in government procurement.
